Cincinnati Reds Baseball and Softball Camps form

RELEASE AND WAIVER OF LIABILITY ("Release") *

I am the parent/legal guardian of the child named above ("Participant").

I acknowledge and have consented to my child's participation in the Reds Baseball Camps (the "Activity").

I represent and warrant that Participant is in good physical and mental health and does not suffer from any mental or physical condition or disability which might render his/her participation in the Activity. I acknowledge that if I believe Activity conditions are unsafe, I will immediately discontinue participation in the Activity.

In consideration of my child's participation in the Activity, on my behalf and on behalf of my child, we hereby release, discharge, and covenant not to sue The Cincinnati Reds LLC, Reds Community Fund, Reds Baseball Camps, LLC, Baseball Done Right, LLC, and their respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place, (each considered one of the "Releasees" herein) from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the negligence of the "releasees" or otherwise, including negligent rescue operations; and I further agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the releasees from any loss, liability, damage, or cost which any may incur as the result of such claim.

WE EXPRESSLY ASSUME ALL RISK OF INJURY (INCLUDING PERMANENT DISABILITY AND DEATH) ARISING OUT OF MY CHILD'S PARTICIPATION, HOWSOEVER CAUSED OR ARISING AND ACCEPT PERSONAL RESPONSIBILITY FOR THE DAMAGES FOLLOWING ANY SUCH INJURY, PERMANENT DISABILITY OR DEATH.

This Release extends to all events involved in the Activity. Any dispute arising in connection with this Release or the Activity shall be governed by Ohio law and any legal suit, action or proceeding arising out of or based upon/relating to this Agreement Release or the Activity shall be instituted in the federal courts of the United States of America or the courts of the State of Ohio in each case located in the City of Cincinnati and County of Hamilton.

I have read this Release, understand that I have given up substantial rights by signing it, on my behalf and on behalf of my child, and have signed it freely and without any inducement or assurance of any nature and intend it be a complete and unconditional release of all liability to the greatest extend allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.
